Introduction
This paper highlights a range of topical issues for lenders to consider in financing transactions.Some of the issues such as market disruption clauses, financial covenant breaches and market flex have become more topical with recent developments in the financial markets over the past months. Other topics such as the impact for lenders of the legislation which applies to borrowers in certain sectors may not be headline issues but remain crucial to lenders and we highlight some of our practical experience on these issues in this presentation.
