Decision of the German Federal Supreme Court on concession agreements
Summary
According to a recent decision of the German Federal Supreme Court dated 29 September 20091 operators of electricity and gas networks in municipal areas are required to transfer the ownership of these networks after the expiry of the concession agreement against payment of an appropriate fee if this has been contractually agreed in the concession agreement.
