Dans ce numéro spécial, nous avons choisi de nous concentrer sur les récents arrêts européens en matière de pratiques tarifaires mises en oeuvre par une entreprise en position dominante. Nous confrontons l’approche de la CJUE avec celle retenue par la Commission dans ses Orientations concernant l’application de l’article 102 TFUE, à travers l’analyse des arrêts Post Danmark et Tomra relatifs, d’une part, aux baisses de prix sélectives non prédatrices et, d’autre part, aux rabais fidélisants.
In this issue
In this special issue, we have chosen to focus on recent EU decisions relating to pricing practices implemented by dominant undertakings. We confront the approach taken by the CJEU with the one adopted by the Commission in its Guidance on the application of article 102 TFEU, through the analysis of the Post Danmark and Tomra cases. The first relates to selective but non predatory price reductions and the second concerns fidelity rebates.
