Never before have Canadian businesses been so focused on the value of patents. With the historic sale of Nortel Networks Corporation's technology patents for US$4.5 billion and the Federal Court of Appeal's approval of business method patents in Canada (Attorney General) v. Amazon.com, Inc. 2011 FCA 328, the patent race is on, leaving businesses and financial institutions scrambling to keep up with their competitors who have been patenting their innovative way of doing business for decades.
From an IP perspective, understanding the value of patents is critical to identifying patent opportunities, building a patent portfolio, or defending against the patent rights of a competitor. From an M&A perspective, companies need to understand how to assess the value of patents as part of the valuation of a business.
