Human rights and workplace harassment
Actions taken against employers pursuant to human rights legislation have become increasingly common and the courts have had to analyze employees’ working conditions and the labour relations practices of businesses in light of employees’ rights pursuant to this legislation. Their decisions have created many obligations for employers and, in particular, a duty of accommodation in situations involving issues of disability, ethnic or national origin and religious practices or beliefs.
