David Lyons is a banking and finance lawyer based in Brisbane.
David specialises in the financial services sector and has extensive experience in advising clients in relation to transactional, advisory/regulatory and corporate matters.
David has acted on behalf of many Australian and international banks, financiers, corporate entities and government owned entities. He has a long-standing interest in business and trade in Asia, and is a board member of a number of Asian business councils and associations. He is also a vice chair of the Financial Services and Products Committee of the International Section of the American Bar Association.
David has extensive experience in multi-jurisdictional finance structuring, infrastructure, resource and project finance, compliance, general banking and finance advice, capital markets and all aspects of corporate, property, acquisition finance, automotive finance, finance leasing, agricultural, trade and business finance.
David has advised in relation to many retail and business banking products and issues such as margin lending, credit cards, safe deposit box terms and conditions, code of banking practice, privacy, EFT code of conduct, anti-money laundering, financial services reform, sponsorship agreements, outsourcing agreements, introducer and agency agreements, trade practices and prudential issues, guarantees and drafted and/or reviewed standard and non-standard security and commercial documentation.
Apart from David’s banking and finance transactional and advisory/regulatory experience, he also provides advice and acts in connection with corporate transactional matters on behalf of financial services clients.
David was listed as one of Australia’s legal Young Gun partners in the Australian Financial Review in 2006.
His areas of expertise are: commercial/corporate/acquisition/structured finance; project, resource and infrastructure finance; property finance; syndicated loans and finance leasing; asset-based lending; treasury and capital markets (including but not limited to ISDA’s and Global Master Repurchase Agreements); trade practices issues for financial service providers; banking law generally (including financial services reform, privacy and regulatory advice in relation to APRA, ASIC and other requirements); Codes of Conduct (such as Banking Code of Conduct, EFT, Anti-Money Laundering); automotive finance and Discount Receivables funding; and corporate law issues relating to banking products.
David has acted for a wide variety of clients including AMP Limited, ANZ, Bank of Queensland, Brisbane City Council, Capital Finance Australia, Consolidated Properties, Bank of China, Commonwealth Bank/BankWest, China Construction Bank, The Export-Import Bank of China, HSBC, HSH Nordbank, ING, Marlin Equity Partners LLC, National Australia Bank, Queensland Government, Rabo Bank, Ray White Invest, RedBridge Pacific, Suncorp Metway and Westpac/St George.
